How does Mediation differ from Arbitration? Mediation is a process that engages the two, or more, parties in communication. My role is that of facilitator not judge. The goal is to get the parties to settle their differences without resorting to expensive or protracted litigation. Keep this in mind -- nothing that is said during the mediation process can be used against either party in subsequent litigation should the mediation process not result in settlement. When a party has engaged his or her attorney the attorney represents that party’s legal interests. The attorney is actively involved in the communication process. How is the Mediator compensated? I am paid a retainer and generally the parties equally share my fee and mediation related expenses. What is the legal effect of a settlement? All mediated settlements have the full force and effect as any contractual agreement. Uncontested divorces are processed through the court system and the related judgments can be enforced in any legal forum. If there's no settlement, then what? The parties are then free to seek whatever legal recourse they choose.
